Public Service Commissioner, Randy Pinocci, Off The Hook

Monday, April 8, 2024, it was reported on Newsbreak that Pinocci entered into a deferred prosecution agreement.  Pinocci pled no contest to a misdemeanor charge of disorderly conduct and got a $100 fine, and admits there was probable cause to charge him with felonies.

In this agreement, Pinocci didn't have to enter any guilty pleas, but, if Pinocci gets in any kind of trouble in the next 6 months, he runs the risk of being recharged with 2 felonies of witness tampering.

What Was Pinocci Initially Charged With?

From Montana Free Press, it's alleged that Pinocci got into an argument with the brother of a tenant.  He allegedly challenged the guy to a fight, and allegedly tried to get the witness to the event to recant their story.

So Here We Are

Dude, people snap.  It happens.  If the whole deal was Pinocci and the tenant's brother arguing, whatever, right?  I'm no law person, but he has no history of being a law breaker.  Maybe that day he was at the end of his rope.

The problem is with the constant denial and alleged witness tampering. An actual responsible adult would say, "Yep, effed the dog there by arguing loudly with someone.  I'm really sorry and I'll make sure it doesn't happen again."

An entitled toddler who doesn't take responsibility for their actions tries to bully a witness into recanting their statement.

An entitled toddler still shouts innocence, EVEN WHEN they plead no contest.

From Shouse California Law Group:

"Pleading no contest (“nolo contendere”) means accepting the conviction but avoiding a factual admission of guilt."
